The conclusion of contract and delivery
1.1 Contracts on venoxy.com webpage are concluded in Polish. The contracting party is Venoxy.com, Venoxy Bartłomiej Kaszak, Andrzeja Struga 25/3, 70-784 Szczecin (Poland), NIP 973-091-91-92, Email: info@venoxy.com.
1.2 Clicking the “confirm order” button leads to placing a binding order for products in your basket. We confirm the order via e-mail directly after you place the order. The conclusion of a binding contract occurs when you receive the order confirmation. Please notice that products you ordered will be sent after you pay the full price ( subject to point 3.2 below) as well as delivery charges unless they are covered by us according to point 2.2 below.
1.3 We fulfill orders in Poland and other European Union countries, the Russian Federation, the United States, Australia and Canada. The estimated time of delivery refers to business days — Monday to Friday (included) except for public holidays.
Prices, shipping charges and express delivery service
2.1 Prices offered while placing an order apply. Prices offered are total prices, i.e. they include VAT at the current rate. Until the full price is paid the product remains our property.
2.2 You can find shipping charges of current shipping tariff in “shipment” tab.
2.3 Price stated next to a product does not include delivery charges.
2.4 The Shop stipulates the right of changing prices of offered products, adding new products for sale, conducting and cancelling promotional actions or making changes to them based on civil code provisions as well as other statues. Such changes do not violate laws of persons that concluded sale contract of products offered by the Shop before the above mentioned changes were introduced or laws of persons eligible to benefit from a given special offer according to its rules and time of running.
2.5 Forwarding expenses are added to the sum of products ordered and are paid by the Customer.
2.6 Shipment is executed according to a chosen method of delivery.
2.7 While picking up the delivery from the courier it is recommended that a Customer checks the outer condition of a package with him or her present. If the package is damaged, it is recommended that a Customer along with a courier draws up a damage protocol in two unanimous copies signed by a customer and a courier. Not acting on the recommendations does not influence the possibility of filing a complaint in the Shop.
2.8 While picking up a delivery, a Customer should check the condition of a package. In case of any reservations, they should choose an option regarding complaints and act according to instructions. Not acting on the recommendations does not influence the possibility of filing a complaint in the Shop.
3. Payments
3.1 Essentially, we offer the following methods of payment: an online bank transfer and PayPal. We stipulate the right not to offer some methods of payment regarding every order. Please remember that we only accept payments from bank accounts operating within the borders of the European Union (EU). Any costs of financial transactions are paid by the customer.
3.2 In the case of credit card payment, the card will be charged along with the delivery being dispatched.
3.3 You hereby grant permission to receive information on crediting the bank account in an electronic form only.
4. The statutory right to withdraw from the contract after the reception of the goods
In the case of purchasing products on venoxy.com webpage, you have statutory right to withdraw from the contract: Most importantly, we want to inform you that in the case of sending products back you can use the return form attached to your order or print it out from your customer account. If you do not have a printer at your disposal, encounter any problems with downloading the form or need a new form, you can also get it through our Customer Care service (contact information below).
Guidance on the right to withdraw from the agreement
You have the right to withdraw from the agreement within 14 days, without stating a reason. The deadline starts when you or a chosen third party (that is not a carrier) came into the product’s possession. In order to execute your right to withdraw from the agreement you have to inform the company Venoxy.com, Venoxy Bartłomiej Kaszak, Andrzeja Struga 25/3, 70-784 Szczecin (Poland), NIP 973-091-91-92, Email: info@venoxy.com on your decision by means of an unequivocal declaration of intent (for example, by sending a letter or an e-mail). You can use the exemplary withdrawal from the agreement form. However, it is not necessary. You can fill in and send the withdrawal from the agreement form or draw up and send any other declaration of intent (also in an electronic form) using the contact form on our webpage. If you choose this option, we will immediately (for example, via an e-mail) confirm that we had received your declaration. In order to exercise the right to withdraw from the agreement it is enough to give notice about exercising this right before the deadline for withdrawing from the agreement.
Effects of withdrawal from the agreement
In the case of your withdrawal from the agreement, we are obliged to immediately, but no later than within 14 days of receiving your notification about the withdrawal from the agreement, give back all payments received from you, including delivery costs (with the exception of additional costs which may occur if you choose other method of delivery than the cheapest offered by us). In order to refund money, we use the same payment method you used during the original transaction unless we settle a different payment method with the customer. We will under no circumstance charge any additional fees if you choose to do so. We can, however, refuse to refund your payment before we receive the product or the proof that it had been sent back (depending on which event occurs sooner).
You, on the other hand, are obliged to send or give the product back immediately, but no later than within 14 days of informing us about the withdrawal from the agreement. The deadline is met if the product is sent before 14 days pass. We will bear the costs of return shipping of products from the countries they were delivered to if you use the return form provided by us (and use the services of carrier stated in the return form or in other way connected to the return). Otherwise, shipping costs will be covered by you. You will answer for lowering the value of the product resulting from using it in a way which exceeds simply judging the characteristics, features and functions of the product.

CAUTION: Exclusion of the right to withdraw from the agreement. The right to withdraw from the agreement does not appertain to a consumer with regard to a contract whose subject of the performance is the Product delivered in a sealed package that you cannot return due to health protection or hygienic reasons if the package was opened after the delivery.
5. Payments returns
All payments returns are sent immediately to the account used for the payment. In the case of paying by bank transfer, payments will be returned to the account the transfer was sent from. In the case of PayPal or credit card payment, the return will be sent to your PayPal account or your credit card. If you used a gift card during shopping, the appropriate amount will be added to your balance which can be used next time.
8. Statutory warranty for defects
8.1 We are obliged to deliver products free from defects to you.
8.2 In the case of any defects of products ordered through venoxy.com we are liable due to the warranty against defects, resulting from Article 556 and statues of 23 April 1964 — Polish Civil Code (Dz.U. [Journal of Laws] from 2016, item 380, as amended).
9. Complaints
9.1 Any complaints regarding products bought in our shop as well as concerning the delivery process ought to be submitted via e-mail. You can report on any problems concerning picking up the return delivery by a courier in the same manner.
9.2 In some cases, we may ask you to send us pictures of products you make a complaint about.
9.3 Your complaint will be processed within 14 days from receiving a complete complaint form. You will be informed about any missing parts in your form immediately. Along such notice, you will receive information on how to complete the required information.
9.4 We also inform that you have the right to use out-of-court resolution of complaints according to online variants of dispute settlement developed by European Commission available online.
11. Complaints/returns model form
In accordance to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on alternative dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on consumer ODR), BartłomiejKaszak hereby shares a link to ODR platform (https://webgate.ec.europa.eu/odr) with Venom Company. The platform allows out-of-court resolution of disputes between traders and consumers. This method is voluntary.
